You Can Send in Your Louisiana Registration

Louisiana registrations are due October 1. The state does not want the registrations much more than 30 days prior to the due date, but you can start sending them in now. Registration is only required in Louisiana if your nonprofit has a contract with a solicitor and if you solicit contributions in the state.

Don’t Delay Your Hawaii Annual Fee Payment!

Each year, registered charities file their annual report with the state of Hawaii, and the registration fee is invoiced via email upon approval of the filed report. The invoice is emailed to the organization and to the individual who filed the annual report. Payment for the registration fee is due within 15 days of the invoice being issued, and effective April 19, 2017, Hawaii’s online payment system will now automatically assess late fees for all registration invoices unpaid after 15 days. Late fees are $20 per day, up to a maximum of $1,000 for each annual report filed....

Utah No Longer Offers Exemptions for Membership Organizations

For years Utah offered an exemption for filing for membership organizations that only solicited their own members. This exemption was outlines in UCA §13-22-8(1)(a). However, on May 9th, 2017, this exemption will no longer be available as amendments to the Charitable Solicitations Act have been made and will go in to effect that day. For organizations that previously had received a membership exemption from registration the state and do not qualify under other exemption categories, such as being a public institution of higher learning, these organization will need to register in Utah if they plan to solicit contributions from residents of the state....

Tennessee Does Away With Fundraiser Registration Requirement

Charitable Solicitation Exemptions for Churches

Like other nonprofit organizations, churches are subject to various Charitable solicitation registration laws if they ask for donations. However, churches can file for charitable solicitation registration exemptions in all states so that they can legally solicit contributions going forward, without the need to file annual registration forms as other nonprofits would. There are about 40 states that require churches and similar entities to file for exemptions. This typically requires filling out an exemption form or filing key documents with the state along with the request for the exemptions. Combined Federal Campaign Announces Fees

The Combined Federal Campaign (CFC) announces that it will begin charging fees to all charities that take part in the campaign. At this point the CFC has released Application fees which are charged to all charities that apply to take part in the Combined Federal Campaign as well as Listing Fees, which are additional fees, that the CFC charges for all charities that are approved to take part in the campaign. The CFC has also stated that it may charge distribution fees in addition to these two other types of fees, but it has not yet released a fee schedule for distribution fees. All organizations in the CFC will pay between $275 to $2,840 to take part. If they are part of a federation, they will likely also have to pay considerably more since they will need to pay the federation fees as well. Below are the tables of fees: Application Fees $400 – Members of National/International Federations $570 – National/International Unaffiliated Organizations $255 – Members of Local Federations $340 – Local Unaffiliated Organizations Listing Fees $2,270 – National/International Organizations with over $1,000,000 in revenue $555 – National/International Organizations with revenue between $250,000 and $1,000,000 $370 – National/International Organizations with less than $250,000 in revenue $635 – Local Organizations with over $1,000,000 in revenue $135 – Local Organizations with revenue between $250,000 and $1,000,000 $20 – Local Organizations with less than $250,000 in revenue...

Filing Deadline Approaching

For many organizations November 15 is the due date for renewing your charitable solicitation registrations. Most states base their charitable solicitation filing due dates on the charity’s fiscal year. Renewing on-time is pivotal to avoid lapses in your state registration and the late fees and fines that often accompany these. For organizations with a December year end, most states allow extensions till around the November 15 due date that the IRS sets as the final date for organizations to file their IRS Form 990 once extensions are factored in. This means that about half of your registrations will come due around November 15th. For charities with a fiscal year ending June 30, November 15 is the initial due date for filing your 990 and the state registration forms in Arkansas, California, Colorado, Hawaii, Kentucky, Massachusetts, Mississippi, New Hampshire, New York, North Carolina, Ohio, Oregon, South Carolina, Virginia. Both the 990 and all of these state filings can be extended. In a few of these states, as long as you file your IRS Form 8868 to extend your IRS filing deadline, you will automatically receive extensions for the state filings.
